NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT IMPROVE YOUR CHANCES OF WINNING.
By participating in this Sweepstakes, Entrants accept and agree to be bound by the following Official Rules:
1. Eligibility: Except where regulated or restricted by law, the Double Tasty Crossbody Giveaway (“Sweepstakes”) is open to legal residents of the fifty (50) United States and the District of Columbia who are 18 years of age or older at the time of entry. Employees, contractors, directors, and officers, and their immediate family members (parents, children, siblings or spouse, regardless of where they live, or persons living in the same household, whether related or not) of the sponsor, Bero Brewing, Inc. (“Sponsor”) or Vuori, Inc. (“Vuori”) or their subsidiaries, affiliates, suppliers, consultants, legal counsel, public relations, sales representatives, marketing agencies, and any others engaged in the development or distribution of this Sweepstakes (Sponsor’s “Affiilates”) are not eligible to enter or win. All federal, state, municipal, and local laws and regulations apply. Void where prohibited or restricted by law.
2. No Endorsement by Instagram; Release of Liability: This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Instagram, and by entering the Sweepstakes you agree to release Instagram from any liability arising from or in connection to the Sweepstakes. You understand that by using and interacting with Instagram.com and Instagram’s software applications, you are subject to the terms, conditions, and policies that govern the use of Instagram. You should therefore review the applicable Instagram terms and policies, including privacy and data gathering practices, before using or interacting with Instagram or participating in this Sweepstakes.
3. Disclaimer: Sponsor, Vuori, and any of their respective affiliated companies, officers, directors, employees, agents or representatives (collectively, the "Released Parties") will not be responsible for: (a) any late, lost, misrouted, garbled or distorted or damaged Entries; (b) phone, electronic, hardware, software, network, Internet, or other computer- or communications-related malfunctions or failures; (c) any Sweepstakes disruptions, injuries, losses or damages caused by events beyond the control of the Released Parties or by non-authorized human intervention; or (d) any printing or typographical errors in any materials associated with the Sweepstakes. Sponsor reserves the right in its sole and absolute discretion to modify these Official Rules, and/or to cancel, terminate, modify or suspend all or any part of the Sweepstakes, and in the event of cancellation or termination, to select a Winner from among all eligible non-suspect Entries received up to the time of such cancellation, termination, modification, or suspension, as applicable.
4. Entry Period: The Sweepstakes begins at 5:00pmEST on June 25, 2025 and ends at 5:00pm EST on July 02, 2025 (“Entry Period”). Entries must be submitted during the Entry Period in order to be eligible for the Sweepstakes.
5. How to Enter: To enter, eligible individuals (each, an “Entrant”) should complete all of the below-listed steps (together comprising an “Entry”) in order to be entered into the Sweepstakes as well as to confirm each Entrant’s consent to and agreement with these Official Rules:
(a) be a registered user of Instagram;
(b) maintain an Instagram account that is publicly viewable and capable of receiving direct messages;
(c) follow @berobrewing and @vuoriclothing on Instagram and continue to follow these accounts at least through the time that Winners have been selected; and
(d) like the contest photo pinned on @berobrewing’s Instagram page and post a comment tagging two (2) friends who you want to share a Double Tasty West Coast Style IPA with.
6. Entry Conditions: Limit one (1) Entry per person during the Entry Period. The use of a fake name or fake social media account or the use of agencies or robotic, repetitive, programmed, or other similar entry methods is prohibited and will disqualify an Entrant. Entries must not include any content which is offensive or which violates or infringes any copyright, trademark/tradename, or other proprietary right of any entity or person (including but not limited to rights of privacy or publicity). Entries must not contain depictions of third party proprietary materials, including without limitation copyrights, trademarks, tradenames, logos, or similar brand identifying marks, and must not contain the names or social media handles of any individuals without their consent; all such Entries will be disqualified. All Entrants agree to abide by these Official Rules and waive any right to claim ambiguity in this Sweepstakes or these Official Rules.
7. Void Entries: Entries are void if they are unreadable, inaccurate, incomplete, do not meet the eligibility requirements, or are otherwise not in compliance with these Official Rules. Entries that are deemed by the Sponsor, in its sole discretion, to be offensive, immoral, obscene, profane, defamatory, infringing, or otherwise not in keeping with the image of the Sponsor, will be void. Further, all Entries that contain copyrighted or proprietary materials or the name, image, or likeness of any individuals, for which the Entrant has not obtained appropriate rights or consent, as well as any content which disparages or portrays the Sponsor or Vuori in a negative light, will be void. Sponsor reserves the right, in its sole discretion, to void any entries from Entrants whom Sponsor believes have attempted to tamper or have tampered with the administration, security, or fairness of this Sweepstakes.
8. Winner Selection: The ten [10] winners (Each a “Winner” and collectively “Winners”) of the Sweepstakes will be randomly drawn from among all eligible Entries, to be held on or about August 1, 2025.
9. Prizes and Approximate Retail Value (“ARV”): Each Winner will be awarded the following prize (“Prize”): one (1) VUORI crossbody bag that perfectly fits two West Coast Style IPAs, with an ARV of $48; and one (1) six-pack of non-alcoholic BERO Double Tasty West Coast Style IPAs, with an ARV of $14; and one (1) $100 gift card to Vuori, with an ARV of $100. All federal, state and local taxes, and all other costs associated with acceptance or use of the Prizes, are the sole responsibility of the Winners. Total, combined ARV of all prizes: [$1,620.00]
10. Odds of Winning: The odds of winning a Prize in the Sweepstakes depend upon the number of eligible Entries received during the Entry Period.
11. Winner Notification and Verification: Each Winner is subject to verification of identity and eligibility prior to the award of any prize. Each Winner will be notified by direct message on Instagram via the Entrant’s account used in the Entry. Within seven (7) days of the date that notification is sent, the winning Entrant must, by return email or by other means as may be directed by the Sponsor, provide a response indicating the Entrant’s acceptance of the Prize and providing the Sponsor with confirmation of the winning Entrant’s identity and eligibility and agreement with the terms and conditions contained in these Official Rules. FAILURE TO PROMPTLY CONFIRM OR TO COMPLY WITH THESE OFFICIAL RULES WILL RESULT IN ENTRANT’S DISQUALIFICATION. Entrants who do not provide a timely and complete response will be disqualified and will forfeit any prize. In addition, any prize will be forfeited if any winning Entrant is found to be ineligible, not in compliance with these Official Rules, or declines to accept the prize or provide requisite information or materials. All other expenses and costs related to the participation in the Sweepstakes or acceptance of a Prize are the Entrant’s sole responsibility.
12. Prize Delivery and Conditions: The Prizes will be delivered within thirty (30) days after Winner confirms acceptance of the Prize and Sponsor verifies each Winner’s eligibility and compliance with the Official Rules. A Prize is non-assignable and nontransferrable, and may not be given, bartered, sold, or exchanged for cash. A Prize has no cash value and must be accepted by the Winner as awarded. A Prize may not be upgraded, and no substitutions by the Winner will be allowed; except Sponsor reserves the right, in its sole discretion, to substitute a Prize for one of equal or greater value if the designated Prize should become unavailable for any reason. The Winner may waive his/her right to receive the Prize. All Prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied (including any implied warranty of merchantability or fitness for a particular purpose).
13. Use of Winner’s Name, Likeness, etc.: Except where prohibited by law, entry into the Sweepstakes constitutes permission for Sponsor to use each Winner’s name, image, likeness, persona, Instagram username, hometown, and/or prize information, in all media now known or later devised throughout the world in perpetuity, for all purposes Sponsor deems appropriate, including for advertising, marketing, promotional, and publicity purposes, without further permission or compensation. As a condition of being awarded any prize, except where prohibited by law, each Winner may (in Sponsor’s sole discretion) be required to execute a further written consent and release, without limitation, to confirm Sponsor’s rights to use each Winner’s name, image, likeness, persona, Instagram username, hometown, and/or prize information without further permission or compensation.
14. Release and Indemnification: BY ENTERING THE SWEEPSTAKES, ENTRANTS RELEASE AND HOLD THE SPONSOR, VUORI, AND THEIR AFFILIATES HARMLESS FROM AND AGAINST ANY AND ALL LOSSES, DAMAGES, RIGHTS, CLAIMS, AND ACTIONS OF ANY KIND ARISING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE SWEEPSTAKES OR PARTICIPATION IN ANY SWEEPSTAKES-RELATED ACTIVITY, OR RESULTING DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE (INCLUDING ANY TRAVEL OR ACTIVITY RELATED TO ACCEPTANCE OF THE PRIZE) AWARDED IN CONNECTION WITH THE SWEEPSTAKES, INCLUDING WITHOUT LIMITATION, PERSONAL INJURY, DEATH, AND/OR PROPERTY DAMAGE, AS WELL AS CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASION OF PRIVACY.
15. Affidavit and Release: As a condition of being awarded any Prize, each winner may (in Sponsor’s discretion) be required to execute and deliver to Sponsor a signed affidavit of eligibility, acceptance of these Official Rules, release of liability, and any other legal, regulatory, or tax-related documents required in Sponsor’s discretion.
16. Privacy: Information submitted in connection with the Sweepstakes will be treated in accordance with these Official Rules and Sponsor’s Privacy Policy (as may be amended from time to time), currently available at https://berobrewing.com/pages/privacy-policy. By entering the Sweepstakes, each Entrant agrees that Sponsor may share Entrant’s personal information with its Affiliates for the purpose of Prize fulfillment in the event Entrant is chosen as a potential Winner. Entrants whose e-mail address or social media handle is submitted as part of this Sweepstakes or claiming a Prize agree that Sponsor may contact them by e-mail or direct message on the social media platform to make Entrant aware of information pertinent to the Sweepstakes, and to distribute information regarding Sponsor’s products, special events, promotional offers, or purchase incentives. Entrants may choose to opt-out of future notifications by clicking the link in the e-mail and following the opt-out instructions. Opting in to specific offers does not improve an Entrant’s chances of winning.
17. Applicable Law: The Sweepstakes, and any disputes that may arise hereunder, shall be governed in all respects by the laws of the state of New York without regard to the conflicts of laws principles of any jurisdiction. Venue with respect to any such disputes shall be had in the state and federal courts of the state of Illinois. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision so long as the general intent of these Official Rules remains in effect. In the event that any such provision is determined to be invalid or unenforceable, these Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained herein.
18. Official Rules: By participating in the Sweepstakes, each Entrant fully and unconditionally agrees to and accepts these Official Rules and decisions of the Sponsor, which are final and binding in all matters relating to the Sweepstakes. The Sweepstakes will be run in accordance with the Official Rules, subject to amendment by Sponsor. Each Entrant must comply with the Official Rules and will be deemed to have received and understood the Official Rules by participating in the Sweepstakes. The terms of the Sweepstakes, as set out in the Official Rules, are not subject to amendment or counteroffer, except as set out herein. If any provisions of the Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision.
