OFFICIAL SWEEPSTAKES RULES 

 

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT IMPROVE YOUR CHANCES OF WINNING. 

By participating in this Sweepstakes, Entrants accept and agree to be bound by the following Official Rules: 

1. Eligibility:  Except where regulated or restricted by law, the Golden Can Sweepstakes 2026 (“Sweepstakes”) is open to legal residents of the fifty (50) United States and the District of Columbia, excluding residents of Florida, Hawaii, New York, and Rhode Island, who are 18 years of age or older at the time of entry.  Employees, contractors, directors, and officers, and their immediate family members (parents, children, siblings or spouse, regardless of where they live, or persons living in the same household, whether related or not) of the sponsor, Bero Brewing, Inc. (“Sponsor”) or its subsidiaries, affiliates, suppliers, consultants, legal counsel, public relations, sales representatives, marketing agencies, and any others engaged in the development or distribution of this Sweepstakes (Sponsor’s “Affiilates”) are not eligible to enter or win. All federal, state, municipal, and local laws and regulations apply. Void where prohibited or restricted by law.

2. Disclaimer:  Sponsor and any of their respective affiliated companies, officers, directors, employees, agents or representatives (collectively, the "Released Parties") shall have no liability or responsibility for any claim arising in connection with participation in this promotion and/or any prize awarded in connection therewith, including without limitation (a) any late, lost, misrouted, garbled or distorted or damaged Entries; (b) postal service failures or interruptions; (c) phone, electronic, hardware, software, network, Internet, QR code, or other computer- or communications-related malfunctions or failures; (d) any Sweepstakes disruptions, injuries, losses or damages caused by events beyond the control of the Released Parties or by non-authorized human intervention; or (e) any printing or typographical errors in any materials associated with the Sweepstakes. Sponsor reserves the right in its sole and absolute discretion to modify these Official Rules, and/or to cancel, terminate, modify or suspend all or any part of the Sweepstakes, and in the event of cancellation or termination, to select a Winner from among all eligible non-suspect Entries received up to the time of such cancellation, termination, modification, or suspension, as applicable.  

3. Entry Period:  The Sweepstakes begins at 08:00 AM Eastern Time on January 1, 2026 and ends at 05:00 PM on May 31, 2026 (“Entry Period”).  Entries must be submitted during the Entry Period in order to be eligible for the Sweepstakes.        

4. How to Enter:  To enter, eligible individuals (each, an “Entrant”) should complete all of the below-listed steps in Method #1 or Method #2 (comprising an “Entry”) in order to be entered into the Sweepstakes as well as to confirm each Entrant’s consent to and agreement with these Official Rules:

Method #1: Finding a Golden Can

(a) During the Entry Period, purchase from any participating brick-and-mortar retailer or from https://berobrewing.com a pack of BERO brew and check to see if the pack includes a “Golden Can”, ten (10) of which have been randomly seeded inside different packs. Purchases from non-participating retailers will not provide an opportunity to enter the Sweepstakes.

(b) Scan the quick response (“QR”) code located on the Golden Can and follow the instructions to complete the online Sweepstakes entry form. The Entry form may require you to provide your name, contact information, proof of purchase, a photo of the Golden Can, and other details to confirm eligibility. 

(c) Entries verified by Sponsor, in its sole discretion, will be entered into the Prize Drawing.

(d) Golden Cans must be purchased, found, and redeemed in accordance with the above steps during the Entry Period to be eligible for participation in this Sweepstakes.

Method #2: Alternative Method of Entry: Mail-In Entry 

(e) To enter without purchase, as an alternative you may mail in an Entry during the Entry Period which contains your name, complete postal address, email address, and phone number, in a #10 business envelope with proper postage to: WEWORK, ATTN: BERO (Q4 Sweepstakes), 524 Broadway, New York, NY 10012.  

(f)    Mail-in Entries must be received by Sponsor during the Entry Period.

(g)    Mail-in Entries verified by Sponsor, in its sole discretion, will be entered into the Prize Drawing.

5. Entry Conditions:  Limit one (1) Entry per person during the Entry Period. The use of a fake name, fake address, fake or multiple phone numbers, or the use of agencies or robotic, repetitive, programmed, or other similar entry methods is prohibited and will disqualify an Entrant. All Entrants agree to abide by these Official Rules and waive any right to claim ambiguity in this Sweepstakes or these Official Rules. Entries are void if they are unreadable, inaccurate, incomplete, do not meet the eligibility requirements, or are otherwise not in compliance with these Official Rules. Sponsor reserves the right, in its sole discretion, to void any entries from Entrants whom Sponsor believes have attempted to tamper or have tampered with the administration, security, or fairness of this Sweepstakes.

6. Winner Selection:  On or around June 1, 2026, Sponsor will randomly select nine (9) winners (each a “Winner” and collectively “Winners”) from among all eligible entries received during the Entry Period (the “Prize Drawing”). The first three (3) Entries selected will be eligible to receive a Gold Prize, the next three (3) Entries selected will be eligible to receive a Silver Prize, and the final three (3) Entries selected will be eligible to receive a Bronze Prize. 

7. Odds of Winning: The odds of finding a Golden Can are approximately 10 in 1,000,000. The odds of winning a prize depend on the number of eligible Entries received.

8. Winner Notification and Verification:  

(a) On or around June 1, 2026, potential Winners will be notified via the email address and/or telephone number provided in the Entry. Within seven (7) days of the date that notification is sent, the winning Entrant must, by return email or by other means as may be directed by the Sponsor, provide a response indicating the Entrant’s acceptance of the prize and providing the Sponsor with confirmation of the winning Entrant’s identity and eligibility and agreement with these Official Rules. 

(b)    Each Winner is subject to verification of identity and eligibility prior to the award of any prize, which will be determined in Sponsor’s sole discretion. As a condition of being awarded any prize, each Winner may (in Sponsor’s discretion) be required to participate in a criminal record check, background check, and/or execute and deliver to Sponsor a signed affidavit of eligibility, acceptance of these Official Rules, release of liability, and any other legal, regulatory, and/or tax-related documents, in Sponsor’s discretion. 

(c)    Entrants will be deemed ineligible and prizes will be forfeited if a potential Winner does not promptly confirm eligibility or is otherwise found to be ineligible, is not in compliance with these Official Rules, declines to accept a prize or provide requisite information, if a prize is returned as undelivered or not collected, or if the Entrant does not timely execute any additional releases, waivers, assignments, licenses, consents, or other documents which may be requested by Sponsor or required under these Official Rules.  

(d)    Sponsor also reserves the right in its sole discretion to disqualify any Entrant based on the results of any criminal record or background check or if Sponsor determines in its sole discretion that awarding the prize to such Entrant might reflect negatively on Sponsor.
 

9. Prizes:  

(a)    Gold Prizes. Each Grand Prize Gold Winner will be awarded: two (2) passes for Winner and up to one (1) guest (each a “Guest”) to attend a special event during calendar year of 2026 in New York or Los Angeles (each, an “Event”), which will be selected in Sponsor’s sole discretion, including without limitation events such as a movie premiere, sporting event, or social entertainment event, and economy class fare allowance up to $1,500 in the form of a travel voucher(s) for return flights or train transportation within the U.S. as may be reasonably required for both Winner and Guest to attend the Event. Guests are subject to Sponsor approval, in Sponsor’s sole discretion, and must U.S. residents and legal age of majority in their state of residence unless Winner is their parent or legal guardian and accompanies them, and must comply with these Official Rules. Approximate Retail Value of each Gold Prize: $2,500. 

(b)    Silver Prizes. Each Silver Prize Winner will be awarded one (1) $500 BERO gift card to be redeemed on berobrewing.com. 

(c)    Bronze Prizes. Each Bronze Prize Winner will be awarded one (1) $250 BERO gift card to be redeemed on berobrewing.com. 

(d)    Approximate Retail Value (“ARV”).  Total, combined ARV of all prizes is no more than $9,750.

10. Delivery and Acceptance of Prizes:  

(a)    Prize Delivery. Within thirty (30) days after Winner confirms acceptance of the prize and Sponsor verifies Winner’s eligibility and compliance with the Official Rules, Sponsor will deliver the Silver and Bronze Prizes and provide further information regarding the Gold Prizes. All expenses and costs related to the participation in the Sweepstakes or acceptance of a prize are the Entrant’s sole responsibility.

(b)    Non-Transferable. A prize is non-assignable and nontransferrable, and may not be given, bartered, sold, or exchanged for cash. A prize has no cash value and must be accepted by the Winner as awarded. A prize may not be upgraded, and no substitutions by the Winner will be allowed.      

(c)    No Warranties. The Winner may waive their right to receive a prize. All prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied (including any implied warranty of merchantability or fitness for a particular purpose).  

(d)    Right to Substitute. Sponsor reserves the right, in its sole discretion, to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason.

(e)    Taxes and Fees. Each Winner is solely responsible for any taxes, fees, or charges associated with their receipt or use of a prize.

(f)    Conduct. By entering the Sweepstakes and accepting a prize, each Winner agrees that Winner and any Guest will behave in accordance with all applicable laws and generally-accepted social practices in connection with participation in any Sweepstakes- or prize-related activity, including without limitation at an Event or in connection with travel to/from an Event. Each Winner understands and agrees that Sponsor has the right, in its sole discretion, to disqualify and remove any Winner and/or Guest from any activity at any time if their behavior at any point: (a) is uncooperative or disruptive; (b) annoys, threatens or harasses any other person; (c) may or does cause damage to any person or property or the reputation of Sponsor or any prize provider; (d) is requested by the Event host or travel Carrier used in connection with the Event; or (d) otherwise violates any policy of Sponsor or the Event host, or these Official Rules. In the case of any of the foregoing, the winner will forfeit all remaining elements of the prize and still be solely responsible for all taxes and other expenses related to the prize.

(g)    Additional Gold Prize Terms for Travel. Economy seating only on flights to and from a major airport in the U.S., to be approved by Sponsor in its sole discretion. Winner’s proposed flight and travel itinerary must be submitted to Sponsor for approval by Sponsor reasonably in advance of the Event, and Sponsor may approve or deny the proposed itinerary in its sole discretion. Winner is fully responsible for securing an appropriate travel itinerary for Winner and Guest to attend the Event, and must provide all necessary travel documents, visas, and insurance. If Winner elects to travel without a Guest, no additional compensation will be awarded. Travel is subject to all applicable terms and conditions of the airline or other carrier that Winner uses. Sponsor is not liable for any delays, accidents, or expenses incurred by Winner and guest as a result of travel in connection with attending the Event or otherwise receiving the prize. Winner and Guest must arrange for their own accommodation and any additional ground transportation which may be required for the Event.

11. Guests:  Gold Prize Winners are permitted to bring a Guest, but not obligated to do so. Each Winner is responsible for any such Guest and shall ensure that such guest complies with Sponsor’s and each prize provider’s procedures and policies. Without limiting any other restrictions set forth in these Official Rules, if any such Guest is deemed a minor in the Guest’s jurisdiction of residence, the Winner must be the minor Guest’s parent or legal guardian in order for the minor Guest to participate. If requested by Sponsor in its sole discretion, prior to participation in any prize, Guests (or their parent or legal guardian if such Guest is deemed a minor in his or her state of residence and is permitted to participate hereunder) must complete a background check and complete, sign and return a liability release, publicity release, signed affidavit of eligibility, acceptance of these Official Rules, and any other legal, regulatory, and/or tax-related documents, in Sponsor’s discretion. Sponsor has the right to refuse any Guest’s participation in a prize for any reason, in Sponsor’s sole discretion. Once a Winner designates a Guest, the Winner cannot change such designation without the express consent of Sponsor, which may be withheld for any reason.

12. Use of Winner’s Name, Likeness, etc.: Except where prohibited by law, entry into the Sweepstakes constitutes permission for Sponsor to use each Winner’s name, image, likeness, persona, social media usernames, hometown, and/or prize information, in all media now known or later devised throughout the world in perpetuity, for all purposes Sponsor deems appropriate, including for advertising, marketing, promotional, and publicity purposes, without further permission or compensation. As a condition of being awarded any prize, except where prohibited by law, each Winner may (in Sponsor’s sole discretion) be required to execute a further written consent and release, without limitation, to confirm Sponsor’s rights to use each Winner’s name, image, likeness, persona, social media usernames, hometown, and/or prize information without further permission or compensation. 

13. No Endorsement by Instagram, Meta, TikTok; Release of Liability: This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Instagram, Facebook, TikTok, or any social media platform on which it is advertised, and by entering the Sweepstakes you agree to release Instagram, Meta, TikTok, and other platforms from any liability arising from or in connection to the Sweepstakes. Any interaction with such platforms is governed by their respective privacy policies.

14. Release and Indemnification:  BY ENTERING THE SWEEPSTAKES, ENTRANTS RELEASE AND HOLD THE SPONSOR, AND THEIR AFFILIATES HARMLESS FROM AND AGAINST ANY AND ALL LOSSES, DAMAGES, RIGHTS, CLAIMS, AND ACTIONS OF ANY KIND ARISING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE SWEEPSTAKES OR PARTICIPATION IN ANY SWEEPSTAKES-RELATED ACTIVITY, OR RESULTING DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE (INCLUDING ANY TRAVEL OR ACTIVITY RELATED TO ACCEPTANCE OF THE PRIZE) AWARDED IN CONNECTION WITH THE SWEEPSTAKES, INCLUDING WITHOUT LIMITATION, PERSONAL INJURY, DEATH, AND/OR PROPERTY DAMAGE, AS WELL AS CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASION OF PRIVACY. 

15. Privacy:  Information submitted in connection with the Sweepstakes will be treated in accordance with these Official Rules and Sponsor’s Privacy Policy (as may be amended from time to time), currently available at https://berobrewing.com/pages/privacy-policy. By entering the Sweepstakes, each Entrant agrees that Sponsor may share Entrant’s personal information with its Affiliates for the purpose of prize fulfillment in the event Entrant is chosen as a potential Winner.  Entrants whose e-mail address, phone number, or social media username is submitted as part of this Sweepstakes or in claiming a prize agree that Sponsor may contact them by e-mail, text, phone, or direct message to make Entrant aware of information pertinent to the Sweepstakes, and to distribute information regarding Sponsor’s products, special events, promotional offers, or purchase incentives. Entrants may choose to opt-out of future notifications by following the opt-out instructions. Opting in to receive communications does not improve an Entrant’s chances of winning.

16.    Applicable Law: The Sweepstakes, and any disputes that may arise hereunder, shall be governed in all respects by the laws of the state of New York without regard to the conflicts of laws principles of any jurisdiction.  Venue with respect to any such disputes shall be had in the state and federal courts of the state of New York. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision so long as the general intent of these Official Rules remains in effect.  In the event that any such provision is determined to be invalid or unenforceable, these Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained herein.

17.    Official Rules:  By participating in the Sweepstakes, each Entrant fully and unconditionally agrees to and accepts these Official Rules and decisions of the Sponsor, which are final and binding in all matters relating to the Sweepstakes. The Sweepstakes will be run in accordance with the Official Rules, subject to amendment by Sponsor. Each Entrant must comply with the Official Rules and will be deemed to have received and understood the Official Rules by participating in the Sweepstakes. The terms of the Sweepstakes, as set out in the Official Rules, are not subject to amendment or counteroffer, except as set out herein.  If any provisions of the Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision.
